Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Ralph - Pet Wellbeing Hub ("we," "us," or "our") concerning your access to and use of the Ralph - Pet Wellbeing Hub mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the App.

By creating an account or using the App, you represent that:

• • You are at least 18 years of age (or the age of majority in your jurisdiction)
• • You are at least 13 years of age (or 16 in the EEA)
• • You have the legal capacity to enter into this agreement
• • All information you provide is accurate and current

Account Registration

Creating an Account

To use Ralph - Pet Wellbeing Hub, you must:

1. 1. Create an account using:
   • - Email address and password, OR
   • - Sign in with Google, OR
   • - Sign in with Apple
2. 2. Provide accurate and complete information
3. 3. Maintain the security of your account credentials
4. 4. Not share your account with others

Account Security

You are responsible for:

• • Maintaining the confidentiality of your password
• • All activities that occur under your account
• • Notifying us immediately of any unauthorized access
• • Taking precautions to prevent unauthorized access

We reserve the right to suspend or terminate accounts that violate these Terms or engage in suspicious activity.

Subscription Plans

Free and Premium Tiers

Ralph - Pet Wellbeing Hub offers:

Subscription Terms

Billing:

• • Subscriptions are processed through Apple App Store or Google Play Store
• • Billing is handled according to your chosen platform's terms
• • Prices are displayed in your local currency before purchase
• • Subscription automatically renews unless cancelled

Auto-Renewal:

• • Subscriptions automatically renew at the end of each billing period
• • Your payment method will be charged 24 hours before renewal
• • You can cancel auto-renewal at any time through your App Store or Google Play account settings

Cancellation:

• • You may cancel your subscription at any time
• • Cancellation stops future billing but does not provide a refund for the current period
• • You retain premium access until the end of your current billing period
• • To cancel: Go to your device's subscription settings (App Store or Google Play)

Refunds

Refunds are governed by Apple App Store and Google Play Store policies:

• • Apple App Store: Request refunds through Apple at https://support.apple.com/billing
• • Google Play Store: Request refunds through Google Play at https://support.google.com/googleplay

We do not have the ability to process refunds directly.

User Content & Your Data

You retain all rights to the data you enter into the App, including pet information, health tracking data, photos, and notes.

License to Us

By using the App, you grant us a limited license to:

• • Store your data on our servers
• • Sync your data across your devices
• • Backup your data for recovery purposes
• • Process your data to provide App functionality

This license is non-exclusive (you retain ownership) and limited to providing and improving our services. It terminates when you delete your account.

Acceptable Use

Permitted Use

You may use the App to:

• • Track your own pets' wellbeing information
• • Store photos and notes about your pets
• • Export and share your pet data as you choose
• • Access features included in your subscription tier

Prohibited Use

You may NOT:

• • Use the App for any illegal purpose
• • Attempt to hack, reverse engineer, or compromise the App
• • Share your account credentials with others
• • Use the App to provide veterinary services to others
• • Violate any applicable laws or regulations
• • Attempt to access other users' data

Veterinary Services Disclaimer

This App does NOT:

• • Provide medical advice, diagnosis, or treatment
• • Replace professional veterinary care
• • Create a veterinarian-client relationship
• • Guarantee accuracy of any wellbeing assessments or tracking

You understand that:

• • All wellbeing tracking features are for informational purposes only
• • You should consult a licensed veterinarian for medical decisions
• • We are not liable for any decisions you make based on App data
• • Emergency situations require immediate veterinary attention

Intellectual Property

The App and all its contents, features, and functionality are owned by Ralph - Pet Wellbeing Hub and are protected by international copyright, trademark, and other intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• • Download and install the App on your personal devices
• • Use the App for personal, non-commercial purposes
• • Access features according to your subscription tier

You may NOT:

• • Copy, modify, or create derivative works of the App
• • Distribute, sell, or sublicense the App
• • Use the App to create a competing product

Data and Privacy

We collect and process your personal information as described in our Privacy Policy.

Key points:

• • We collect account information and pet wellbeing data
• • We use secure third-party services (Clerk, Supabase, PowerSync)
• • We do NOT sell your personal information
• • We do NOT track your location
• • Session tracking is disabled

You may delete your account at any time through App settings:

• • Deletion is permanent and cannot be undone
• • All your data is permanently deleted from our systems
• • Your subscription is cancelled (no refund for current period)

Third-Party Services

The App integrates with third-party services including:

• • Clerk (authentication)
• • Supabase (database and file storage)
• • PowerSync (data synchronization)
• • RevenueCat (subscription management)
• • Apple App Store and Google Play Store (payment processing)
• • Sentry (error tracking)

Use of third-party services is subject to their respective terms. We are not responsible for third-party service failures.

Disclaimers and Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

• • MERCHANTABILITY
• • FITNESS FOR A PARTICULAR PURPOSE
• • NON-INFRINGEMENT
• • ACCURACY OR RELIABILITY
• • UNINTERRUPTED OR ERROR-FREE OPERATION

You acknowledge that use of the App is at your sole risk and that you are responsible for all pet health decisions.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

WE SHALL NOT BE LIABLE FOR ANY:

• • Indirect, incidental, special, or consequential damages
• • Loss of profits, data, or business opportunities
• • Damages resulting from your use or inability to use the App
• • Damages related to pet health decisions or outcomes
• • Damages from third-party services or unauthorized access

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF: The amount you paid for your subscription in the 12 months before the claim, OR $100 USD.

Term and Termination

These Terms remain in effect while you use the App.

You may terminate your account at any time by:

• • Deleting your account through App settings
• • Uninstalling the App
• • Cancelling your subscription

We may suspend or terminate your access for:

• • Violation of these Terms
• • Fraudulent or illegal activity
• • If required by law

Upon termination, your right to use the App immediately ceases and we may delete your data (except as required by law).

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• • Updating the "Last Updated" date
• • Providing notice in the App
• • Sending an email notification (if applicable)

Continued use of the App after changes constitute acceptance of the new Terms. If you do not agree to the changes, you must stop using the App.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

Informal Resolution: Before filing a claim, you agree to try to resolve disputes informally by contacting us at [email protected].

Any legal action must be brought in the courts of the Netherlands.
